Terms of Service

1. Acceptance of Terms

By creating an account or using MyPusta (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including visitors, registered users, and family members invited to collaborate on a family tree.

2. Description of Service

MyPusta is an online platform that allows users to create, manage, and share family trees. The Service enables users to:

• Add family members, relationships, dates, and photographs • Invite relatives to collaborate on shared family trees • Store and access family history across devices

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts

To access certain features, you must register for an account. You agree to:

• Provide accurate and complete information during registration • Maintain the security of your password • Notify us immediately of any unauthorized access • Accept responsibility for all activity that occurs under your account

You must be at least 13 years of age to create an account. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms.

4. User Content

You retain ownership of all content you submit to MyPusta, including names, photographs, dates, and other family data ("User Content").

By submitting User Content, you grant MyPusta a limited, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service to you and your invited family members.

You are solely responsible for ensuring you have the right to submit any content, including photographs or information about other individuals. Do not upload content that violates the privacy or rights of others.

5. Privacy

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose • Upload content that is defamatory, obscene, or infringes any third-party rights • Attempt to gain unauthorized access to any part of the Service • Scrape, crawl, or use automated means to access the Service • Impersonate any person or entity • Interfere with or disrupt the integrity or performance of the Service

Violation of these prohibitions may result in immediate account termination.

7. Intellectual Property

The MyPusta name, logo, product design, and all related materials are the intellectual property of MyPusta and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary information without our prior written consent.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for the accuracy of any genealogical information submitted by users.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETPUSTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $10 (USD), WHICHEVER IS GREATER.

10. Termination

You may delete your account at any time from your account settings. Upon deletion, your data will be removed from our systems within 30 days, except where we are required to retain it by law.

We may suspend or terminate your account at any time if we believe you have violated these Terms or for any other reason at our discretion, with or without notice.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Nepal, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kathmandu, Nepal.
